SCENARIO
Mohammed Khalid, a U.S. citizen born in Chicago, has filed a civil suit
against O'Hare International Airport and the Transportation Security
Administration. The incident in question happened in June, 2009,
at O'Hare. Mr. Khalid's photograph was taken secretly while waiting in
the check-in line at American Airlines, and he was subsequently
detained at the security check-in site. Facial recognition
software had identified him as on the TSA security watch list. His name
was similar to a name on that list. The software, however, was
not sophisticated enough to distinguish the two faces. Mr. Khalid, who
runs a software consulting company, was detained six hours and missed
his business meeting in Atlanta. He is claiming:
a) irreparable damage to his business and reputation;
b) violations of his Fourth Amendment rights;
c) damages of $1.5 million;
d) elimination of the facial recognition software used at O'Hare.
As a juror, you have to make a decision about Mr. Khalid's suit. You
can take several courses; in fact, of the list below, you can choose
more than one.
1. You can find in favor of Mr. Khalid and all his claims;
2. You can find against Mr. Khalid;
3. You can award him any amount of damages;
4. You can agree that his business and reputation was damages;
5. You can order facial recognition halted (but give your reason);
6 You can agree that his Fourth Amendment rights were violated.

juror.
The Fourth Amendment to the U.S. Constitution follows:
Amendment 4 - Search and Seizure. Ratified 12/15/1791.
The right of the people to be secure in their persons, houses,
papers, and
effects, against unreasonable searches and seizures, shall not be
violated,
and no Warrants shall issue, but upon probable cause, supported by Oath
or
affirmation, and particularly describing the place to be searched, and
the
persons or things to be seized.
